Computer Chick Service Agreement / Work Authorization (V.5.1)
By requesting or receiving services from Computer Chick, CLIENT acknowledges and agrees to the following terms:
- Legal Capacity
CLIENT affirms they are of legal age and capacity to enter into a binding agreement under Ohio law.
- Device Ownership
CLIENT affirms they are the legal owner of any device(s)/property surrendered to Computer Chick for services, or have full authorization from the legal owner(s).
- Payment Responsibility
CLIENT is responsible for all charges related to services provided by Computer Chick, including any recurring services CLIENT enrolls in.
- Time and Cost Estimates
Repair costs and timeframes (including shipping for ordered parts) are estimates only and subject to change based on actual delivery time and repair complexity. Sales tax is not included unless specifically stated.
- Collections and Abandoned Property
- Invoices not paid within 30 days of ticket closing may incur an additional fee of $10/week, up to a maximum of $120.
- Any property not retrieved within 60 days of ticket closing will be considered abandoned, and ownership will transfer to Computer Chick. Such property may be disposed of without further notice.
- Unpaid balances must be settled before any future work will be accepted, even if CLIENT’s property has been disposed of.
- Deposits and Service Rates
- A non-refundable deposit of $50 is required to reserve all appointments (unless waived by a Service Plan). Any unused portion of the deposit will be credited toward future services.
- In-Shop Services ($120/hr or Flat-Rate): Deposits apply toward diagnostic fees unless otherwise stated.
- Remote Services ($100/hr): The deposit covers up to 30 minutes of support. Additional time is billed at $25 per 15 minutes. A valid credit card is required, and the balance will be billed upon service completion.
On-Site Services ($150/hr): 1hr minimum. Deposit is applied to first hour. Additional time is billed at $37.50 per 15 minutes. A valid credit card is required, and the balance will be billed upon service completion. Final balance may be paid by Cash, Check or Card on file (with a 3.5% processing fee). If an on-site service is cancelled within 3 hrs of the appointment time, Client is STILL RESPONSIBLE for the minimum fee of $50 and any applicable travel fee to the site.
Special Order Parts: A deposit covering at least the cost of parts (plus shipping) is required. Deposits are refundable only if:
- The part is not needed for repair,
- The part cannot be sourced, or
- Computer Chick declines the repair.
Once ordered, CLIENT is responsible for any return shipping or restocking fees. Refunds or credits will be issued only after Computer Chick is credited by the distributor.
- Payment & Refunds
- Accepted forms: Cash, Check, and all major credit cards.
- A 3.5% processing fee applies to credit card payments, except deposits under $100 or recurring monthly charges.
- Returned checks will incur a $35 fee.
- Invoices unpaid after 30 days may be sent to collections. CLIENT will be responsible for any collection and/or legal fees.
- Computer Chick does not typically offer refunds. Please see our WARRANTY section for more information.
- Warranty
Services:
Computer Chick charges for the time invested in working on CLIENT’s device. If a problem cannot be resolved, payment may still be required for the time spent. If Computer Chick states that an issue has been resolved and it recurs within 7 days of ticket closure, CLIENT may return the device for further work without an additional diagnostic fee. Additional charges may apply if the issue is outside the original scope of work.
Parts:
- New Parts: Covered by the manufacturer’s warranty. If an issue arises during the warranty period, Computer Chick will assist CLIENT with the manufacturer’s warranty claim.
- Used/Refurbished Parts: Covered by Computer Chick for 30 days from the date of installation, limited to hardware defects only.
- Extended Warranty: CLIENT may be offered the option to purchase additional coverage at the time of purchase.
- Scope: Computer Chick’s hardware warranty covers the replacement cost of the part only, which must be installed by Computer Chick. There may be additional labor fees.
Computers:
- New Branded Computers (HP, Dell, Lenovo, etc.): Covered by the manufacturer’s warranty (minimum 1 year). Additional coverage may be available for purchase.
- CHICKBYTE Branded Computers: Include a 3–5 year hardware replacement warranty through Computer Chick.
- Custom-Built Computers: Built with new hardware; covered by the manufacturer’s hardware warranty.
- Refurbished Computers: Covered by a 1-year hardware warranty through Computer Chick.
- Refunds: Refunds are not offered on computer sales.
Warranty Refunds / Credits:
Refunds are not standard. At its sole discretion, Computer Chick may issue partial account credit toward future services in connection with warranty issues. Computer Chick strives to be fair and reasonable with CLIENTS and expects the same in return.
- Data
Computer Chick is not responsible for any data loss. CLIENT is strongly encouraged to back up important data before service. If Data Backup/Recovery is requested, Computer Chick will make reasonable efforts to preserve data, but recovery is not guaranteed.
- Privacy and Unlawful Materials
Computer Chick will report suspected illegal content, including child pornography, abuse, or stolen property, to the appropriate authorities. Otherwise, CLIENT data will be treated as confidential to the best of Computer Chick’s ability.
- Intellectual Property
All creative works (e.g., graphics, websites, documents) produced by Computer Chick remain the sole property of Computer Chick until full payment is received.
- Modifications During Service
Computer Chick may affix identification labels to CLIENT’s hardware and may install temporary software or tools required for diagnostics or repair. Installation of Computer Chick’s free monitoring/support tool is standard unless CLIENT requests otherwise. These installations will not harm the device.
- Manufacturer Affiliation and Warranty
COMPUTER CHICK IS NOT AFFILIATED WITH APPLE, INC. OR ANY OTHER HARDWARE MANUFACTURER. CLIENT acknowledges that services provided by Computer Chick may void manufacturer or third-party warranties or service plans.
- Contract Termination
If CLIENT cancels service after repairs have begun, CLIENT remains responsible for the cost of work completed. Retrieval of hardware before repairs are finished may result in the device being inoperable or partially disassembled, even if functional prior to service.
This Agreement will remain in effect until terminated in writing by either party. Computer Chick may update or modify these Terms of Service at any time with written notice to CLIENT. If CLIENT agrees to the updated Terms, no action is required and the new Terms will automatically apply. If CLIENT does not agree to the updated Terms, CLIENT must notify Computer Chick in writing within 30 days of receiving notice of the changes. In such case, any project currently in progress will continue under the Terms previously agreed upon, but future services will be suspended until new Terms are accepted.
- Limitation of Liability
CLIENT acknowledges that repair of electronic devices involves risk. Except where prohibited by law, Computer Chick is not liable for any incidental, indirect, or consequential damages, including data loss, arising from services rendered.
- Arbitration
All claims or disputes under this Agreement shall be resolved by binding arbitration in Ohio, unless another location is mutually agreed upon. Arbitration will follow the Commercial Arbitration Rules of the American Arbitration Association.
- Arbitration shall remain confidential.
- The arbitrator shall provide a written decision including conclusions of law and fact.
- Costs, expenses, and reasonable attorneys’ fees may be awarded.
- Any arbitrator with ties to a competing business may be objected to.
- Arbitration awards may be confirmed in a court of competent jurisdiction.
